B2B Terms for Burgmann Radar

Business customers only: Burgmann Radar is offered solely to entrepreneurs and other professional customers acting in the course of their business or professional activity. Consumers may not enter into a subscription.

1. Provider and contact

The provider is Ing. Reinhard Wolfgang Burgmann, BA, trading as Burgmann Capital, Fasangasse 8, 2514 Möllersdorf, Austria, VAT ID ATU82775169. Product and contract contact: radar@burgmann.pro. Further provider details are available in the legal notice.

2. Scope

These terms apply to B2B subscriptions for Burgmann Radar. Customer terms apply only if expressly accepted in text form. Individually agreed terms take precedence.

3. Contract formation

The website is an invitation to place an order. The customer selects a country edition and term, confirms its business status and these terms, and submits a paid order through Stripe's payment page. The customer represents that it is acting in the course of a business or professional activity and is authorised to enter into the contract.

The contract is formed once payment has been confirmed successfully and Burgmann Capital has activated or confirmed the subscription. Burgmann Capital may reject an order, particularly where business status is not established, information is incomplete or inconsistent, payment fails or an obvious pricing or system error occurs; any amount already collected in that case will be refunded.

4. Service and delivery

The subscription covers the selected country edition of Burgmann Construction Radar as a source-oriented digital briefing. The first regular edition is supplied on the first Monday following successful payment and activation; subsequent editions are supplied weekly, generally by 12:00 on Mondays in the Europe/Vienna time zone, to the business email address provided.

Public holidays, exceptional source conditions, technical incidents or necessary quality review may result in a reasonable delay. The customer must keep its recipient address available and promptly notify Burgmann Capital of delivery issues.

The scope and number of included items depend on the reportable source material available. No minimum volume or particular commercial outcome is promised. The agreed regular preparation remains unaffected; information in original sources may change or contain errors.

5. Sources, AI assistance and customer review

AI-assisted tools may be used for research, extraction, structuring, prioritisation and editorial preparation. A complete human review of every individual item is not promised. Customers must independently verify sources, deadlines, content, relevance and commercial usability before making decisions. Radar is not legal, tax, procurement, investment or other professional advice and does not promise an award, contract or commercial success.

6. Prices, VAT and invoicing

All prices displayed on the Radar website are net prices and exclude any applicable VAT. The total shown in checkout and the billing and tax details collected there are decisive. The customer must provide accurate and complete billing and tax information. Where the legal requirements are met and a valid VAT ID is supplied, the reverse-charge mechanism may apply. Invoices are supplied electronically.

7. Payment, term and renewal

Payments are processed by Stripe; Burgmann Capital does not store full card details. The subscription starts when the contract is formed and runs monthly or annually, as selected. It automatically renews for a further month or year unless cancelled before the next renewal date. The recurring amount is charged to the stored payment method on each renewal date.

If a payment fails, Stripe and Burgmann Capital may make further collection attempts or request payment. Delivery may be suspended until payment is settled. If payment remains outstanding after a reasonable grace period, Burgmann Capital may terminate the subscription for cause. Service may be reactivated once payment has been settled in full.

8. Cancellation

The customer may cancel at any time before the next renewal date by emailing radar@burgmann.pro. Cancellation takes effect at the end of the current paid period, and service remains available until then. Burgmann Capital will confirm receipt and the effective end date to the registered business email address.

Either party's right to terminate for cause remains unaffected. Burgmann Capital may terminate for cause in particular in the event of continuing payment default or a material breach of the confidentiality and use restrictions.

9. Refunds

Billing periods that have begun and have been duly supplied are generally not refunded pro rata. Mandatory rights and refunds for duplicate charges, incorrect charges or non-delivery attributable to Burgmann Capital remain unaffected. No consumer withdrawal right applies because the service is exclusively B2B.

10. Use rights

The briefings, their compilation, evaluation and prioritisation are confidential. The customer receives a non-exclusive, non-transferable right to use the briefings delivered during a paid subscription period permanently within its own business for internal business purposes. Access must be limited to employees who need the content for their work and are bound by confidentiality obligations.

Without Burgmann Capital's prior consent, the customer must not, in whole or in part, disclose the content to third parties or affiliated companies, publish it, reproduce it beyond necessary internal use, resell it, use it to create a competing information product, or upload or submit it to publicly accessible or third-party platforms, databases or AI systems. Mandatory legal disclosure obligations remain unaffected; where legally permitted, Burgmann Capital must be informed in advance.

The confidentiality and use restrictions continue to apply to briefings already delivered after the contract ends. Rights in linked original sources and information that is publicly known, already lawfully known to the customer, independently developed or lawfully received from a third party remain unaffected. Sample reports expressly marked by Burgmann Capital as public demos are exempt from the redistribution restrictions.

11. Changes to the offering

Burgmann Capital may improve sources, presentation and technical processes provided the essential benefit of the selected edition is maintained. Material adverse changes to service or renewal conditions will be communicated at least 30 days before they take effect. Price changes apply no earlier than the next renewal period. The customer may cancel before the change takes effect with effect from the change date.

12. Force majeure and extended disruption

Neither party is liable for delays beyond its reasonable control, including failures of essential infrastructure, official measures or exceptional disruption to source and communication services. Burgmann Capital will provide information about material disruption and make up missed editions where reasonable and practicable. Appropriate refunds or termination for cause remain available in the event of extended complete non-delivery.

13. Liability

Liability is unlimited for intent, gross negligence, personal injury and other mandatory statutory liability. For a slightly negligent breach of an essential contractual duty, liability is limited to the typical foreseeable loss. Liability for other slight negligence is excluded. In particular, Burgmann Capital is not liable for decisions made without independent verification solely on the basis of a Radar briefing.

14. Privacy and third parties

Information on personal-data processing is provided in the privacy policy. Payment data is processed by Stripe. Linked original sources and other third-party services are subject to their providers' terms.

15. Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. To the extent legally permitted, the courts having subject-matter jurisdiction at the provider's registered place of business have exclusive jurisdiction.

16. Final provisions

If any provision is or becomes invalid, the remaining provisions remain effective. German and English are provided as contract languages. If the language versions differ, the German version prevails. The versioned terms incorporated when the order is placed govern the contract.
